Welcome to Kyytiin ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Kyytiin platform, a service that connects travelers with individuals who need assistance with deliveries, document transport, pet transport, and related services.

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Definitions

• "Platform" refers to the Kyytiin website and mobile application.
• "Traveler" refers to users who offer to transport items or provide services during their travels.
• "Requester" refers to users who request transportation or delivery services.
• "Service" refers to any service facilitated through the Platform.
• "User" refers to any person who accesses or uses the Platform.

3. Eligibility

To use our Platform, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Have the legal capacity to enter into binding agreements.
• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials.
• Comply with all applicable laws and regulations in your jurisdiction.

4. User Accounts

You are responsible for maintaining the confidentiality of your account information and password. You agree to:

• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.
• Ensure that all information provided is accurate and up-to-date.

5. Prohibited Items and Activities

Users are strictly prohibited from using the Platform to transport or facilitate the transport of:

• Illegal substances, drugs, or controlled substances.
• Weapons, firearms, or ammunition.
• Hazardous materials, explosives, or flammable substances.
• Stolen goods or items obtained illegally.
• Items that violate intellectual property rights.
• Items prohibited by applicable customs or import/export laws.
• Perishable items requiring special handling without proper arrangements.

Violation of this section may result in immediate account termination and legal action.

6. Service Fees and Payments

Fees for services are agreed upon between Travelers and Requesters through the Platform. Kyytiin may charge a service fee for facilitating transactions. All fees are displayed before confirmation of a service request.

Payment processing is handled through secure third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method for all fees.

7. User Responsibilities

Travelers:

• Accurately describe available space and services.
• Comply with all applicable customs, import, and export regulations.
• Safely transport items in accordance with agreed terms.
• Maintain appropriate insurance coverage if required.
• Communicate promptly and professionally with Requesters.

Requesters:

• Accurately describe items to be transported.
• Ensure items comply with all applicable laws and regulations.
• Provide complete and accurate delivery information.
• Make timely payments as agreed.
• Be available for item pickup/delivery as arranged.

8. Limitation of Liability

Kyytiin acts as a platform connecting Travelers and Requesters. We are not a party to any transaction between users and do not assume responsibility for:

• Loss, damage, or theft of items during transport.
• Delays in delivery or service completion.
• Disputes between Travelers and Requesters.
• Violations of customs or import/export regulations.
• Any illegal activities conducted through the Platform.

To the maximum extent permitted by applicable law, Kyytiin's liability is limited to the amount of fees collected by Kyytiin in connection with the specific transaction giving rise to the claim.

9. Dispute Resolution

In accordance with European Union regulations, users have the right to resolve disputes through:

• Direct communication between parties.
• Kyytiin's dispute resolution process.
• Alternative dispute resolution (ADR) mechanisms.
• Competent courts in your jurisdiction, as provided by EU law.

For EU residents, you may also contact the European Consumer Centre in your country for assistance with cross-border disputes.

10. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Kyytiin or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason we deem necessary to protect the Platform and its users.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified to users via email or through a prominent notice on the Platform. Continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the European Union and applicable national laws. For EU residents, your local consumer protection laws apply. Any disputes will be subject to the jurisdiction of the competent courts in your country of residence, as provided by EU Regulation 1215/2012.
